In the example below a driver using Solo Standard Hours has worked for 14 hours and 30 minutes from midnight to midnight on Day 2 and is not in breach. How can this be so given that a driver using Solo Standard Hours can only work for a maimum of 12 hours in a 24 hour period?

That’s because 24 hour periods are not counted from midnight to midnight as set out on the daily sheet. Periods of 24 hours or longer must be counted forward from the end of a ‘relevant major rest break.’ In the case of Standard Hours, this is a 7 hour rest break.

The 24 hour period in this example is counted from 12 noon on Day 1 to 12 noon on Day 2.

In that 24 hour period the driver has worked for a total 10 hours and 45 minutes (6 hours and 45 minutes on Day 1 plus 4 hours on Day 2) and taken the required 7 hour break (5am to 12 noon on Day 2).

The remaining 10 hours and 30 minutes of work on Day 2 is counted in the next 24 hour period which starts from 12 noon on Day 2 and would end at 12 noon the next day.
